A ação tem o objetivo de pressionar o Congresso a instalar a Comissão Mista de Orçamento para a discussão da LOA antes da votação em Plenário
A LOA – Lei Orçamentária Anual tem de ser discutida na Comissão Mista de Orçamento. Para garantir que isso aconteça, a deputada federal Adriana Ventura, com a bancada do partido NOVO na Câmara dos Deputados, impetrou no dia 17 de dezembro, o Mandado de Segurança Nº 37603 no Supremo Tribunal Federal. Ali, solicita a instalação imediata da Comissão Mista de Orçamento (CMO). A ação tem o objetivo de pressionar o presidente do Congresso Federal, Davi Alcolumbre, para a instalação da Comissão com o intuito de discutir o Projeto de Lei Orçamentária Anual (LOA) em profundidade antes de ir à votação em Plenário.
A deputada afirma que este é um dever constitucional e precisa ser respeitado.
“É impraticável que o Congresso Nacional queira votar emendas orçamentárias de 594 parlamentares de uma vez, sem nenhum parecer prévio da CMO”, alerta a parlamentar. “Votamos a LDO sem passar pela CMO para não prejudicar o País. Mas não vamos aceitar que a mesma violação à Constituição se repita com a LOA”.

I – Atribuições da Comissão
A Comissão Mista de Planos, Orçamentos Públicos e Fiscalização (CMO), órgão legislativo do Congresso Nacional, composta por Deputados e Senadores, foi instituída pelo art. 166, § 1º, da Constituição Federal de 1988, com as seguintes atribuições:
Art. 166. Os projetos de lei relativos ao plano plurianual, às diretrizes orçamentárias, ao orçamento anual e aos créditos adicionais serão apreciados pelas duas Casas do Congresso Nacional, na forma do regimento comum.
§ 1º – Caberá a uma Comissão mista permanente de Senadores e Deputados:
I – examinar e emitir parecer sobre os projetos referidos neste artigo e sobre as contas apresentadas anualmente pelo Presidente da República;
II – examinar e emitir parecer sobre os planos e programas nacionais, regionais e setoriais previstos nesta Constituição e exercer o acompanhamento e a fiscalização orçamentária, sem prejuízo da atuação das demais comissões do Congresso Nacional e de suas Casas, criadas de acordo com o art. 58.
O processo de apreciação dos projetos de lei relativos ao ciclo orçamentário, constituído pelo Plano Plurianual (PPA), Lei de Diretrizes Orçamentárias (LDO) e Lei Orçamentária Anual (LOA), difere do processo legislativo de apreciação das demais leis. O processo legislativo orçamentário é ressalvado expressamente no texto constitucional:
Art. 166, § 7º – Aplicam-se aos projetos mencionados neste artigo, no que não contrariar o disposto nesta seção, as demais normas relativas ao processo legislativo.
