A Comissão Especial do PL 8045/2010, sobre Reforma do Código de Processo Penal – CPP, foi extinta no início de junho de 2021
No lugar da Comissão ficará um grupo de trabalho, ao qual caberá produzir a redação final para o parecer do novo CPP. “Isso é um prejuízo para a democracia, pois no Grupo de Trabalho não há necessariamente o respeito à proporcionalidade dos partidos na composição”, manifestou a deputada Adriana Ventura. Segundo a parlamentar, essa prática já aconteceu no GT do Pacote Anticrime e o resultado não foi bom.
Entre os assuntos mais importantes para serem discutidos na Reforma do Código Penal estão: a prisão após condenação em segunda instância e o fim do Juiz de Garantia.
A deputada federal Adriana Ventura irá trabalhar para:
- que a prisão após condenação em segunda instância seja aprovada;
- que não haja retrocesso na capacidade investigatória do Ministério Público;
- que indícios continuem sendo usados como fundamentação para condenação, principalmente em casos de corrupção e lavagem de dinheiro;
- que o CPP preveja modelos de acordo penais como o plea bargain e o acordo de não-persecução penal;
- que os recursos que visam apenas protelar a sentença do juiz sejam limitados no processo penal;
- que o Juiz de Garantias seja retirado do CPP.
