A deputada federal apresentou Projeto de Lei para garantir penalidades na aquisição indevida do benefício
A deputada federal Adriana Ventura (NOVO/SP) aponta que os recursos desviados pelos fraudadores poderiam estar sendo aplicados em uma série de necessidades coletivas e reprova qualquer tipo de ação que prejudique o erário, principalmente se tratando de candidatos políticos.
Auditoria do TCU identificou que 11 mil candidatos a prefeitos e vereadores requereram o auxílio emergencial. De acordo com o estudo, os concorrentes declararam patrimônio acima de R$ 300 mil. A deputada federal Adriana Ventura (NOVO/SP) aponta que os recursos desviados pelos fraudadores poderiam estar sendo aplicados em uma série de necessidades coletivas e reprova qualquer tipo de ação que prejudique o erário, principalmente se tratando de candidatos políticos.
“Antes mesmo de assumirem o papel de agentes públicos estão lesando os cofres. Isso é incompatível com o cargo que estão pleiteando, pois eles devem garantir a boa destinação do dinheiro público e não arrumar formas de burlar o sistema”, reitera a deputada.
Para tentar garantir a penalidade necessária para os que estão recebendo de forma indevida o auxílio emergencial, Adriana Ventura protocolou em junho deste ano o Projeto de Lei nº 3186/2020, que propõe o aumento de um terço nas penas previstas pelo Código Penal para fraudes, além de determinar a restituição aos cofres públicos em dobro de valores indevidos recebidos.
Neste sentido, também foi aprovado na Câmara e agora aguarda aprovação no Senado o PL n° 1485/2020, de autoria da deputada, que inclui os crimes de estelionato e falsidade ideológica nos casos de fraudes envolvendo o auxílio financeiro em virtude do estado de calamidade pública.
“Não podemos permitir que esses cidadãos se aproveitem dessa situação excepcional para obter inapropriadamente o benefício. Por isso, propus a criação de fundamento legal para persecução criminal de tais atos, altamente reprováveis, bem como o endurecimento das punições e devolução em dobro do benefício, nos casos relacionados ao reconhecimento de fraude e má fé na percepção do auxílio emergencial”, alega a deputada.
